The full explanation

Karnataka cut its Labour Welfare Fund applicability threshold from 50 employees to 10, with effect from 7 January 2026. That single change brings a large number of establishments into the fund that were previously outside it entirely. This is a different kind of amendment from a rate revision, and it fails differently. A rate change affects establishments already contributing, and the error shows up as a wrong amount. A threshold cut affects establishments that have never contributed, have no registration, no remittance process and no calendar entry. Nothing in their payroll changes, nothing produces an error, and they simply remain outside a fund they are now required to be inside. The specific risk is establishments in the 10 to 49 employee band. Anyone below 50 had a correct and settled position under the old threshold, and correctness under a superseded rule looks identical to correctness under the current one from inside the system. Three steps follow. Count employees at each Karnataka establishment against the 10-employee threshold rather than assuming the previous position holds. Where an establishment now qualifies, register with the Karnataka Labour Welfare Board rather than simply starting to deduct, since remittance without registration will not be credited. And check whether liability runs from 7 January 2026 or from the date of registration, because those are not necessarily the same and arrears may be due. Note also that a threshold cut of this size usually reflects a policy decision to widen coverage rather than a technical correction, which makes enforcement attention more likely rather than less in the period after it takes effect.
