At a glance

The 'Punjab Labour Welfare Fund (Haryana Amendment) Act, 2021' (Act 16 of 2021, 5 April 2021) amends the Punjab Act in its application to HARYANA, not to Punjab: it substituted s.9A(2) requiring employers to pay both shares before 31 December each year online. The full explanation

Punjab's Labour Welfare Fund is Rs. 5 from the employee and Rs. 20 from the employer per month, under the 2021 Act. That is a one-to-four ratio - a fourth distinct pattern, alongside one-to-two in Tamil Nadu and Haryana, one-to-three in Maharashtra, Madhya Pradesh and Chhattisgarh, and one-to-ten in West Bengal. Andhra Pradesh manages a fifth at roughly one to two and a third. There is no convention to fall back on. Punjab is also the state where the two state-level deductions are most easily confused with each other. Alongside the labour welfare fund it levies the Punjab State Development Tax under the State Development Tax Act 2018, at a flat Rs. 200 per month on persons liable to income tax. That development tax functions as professional tax, even though Punjab has no statute called a professional tax Act and most reference tables therefore list it as non-levying. So a Punjab payslip carries two separate monthly state deductions of very different sizes: Rs. 5 to the labour welfare fund and Rs. 200 as development tax. Configuring one and not the other is a common outcome, and the missing one produces no error anywhere. Chandigarh follows the Punjab Rules for its labour welfare fund while having no professional tax of its own, so a change to the Punjab Rules changes Chandigarh's obligation without any Chandigarh notification issuing. Note also that the 2021 Act replaced the earlier Punjab framework, so any reference material predating it is superseded and should not be used to configure the deduction.
